Since the August 2005 IRS Ruling on Tool Reimbursement Plans, there has been a great deal of misinformation about what is considered as a valid Accountable Plan.

Unfortunately, there are still several programs being offered that we believe
do not meet the requirements of being considered an Accountable Plan.


What is an Accountable Plan  ...

An Accountable Plan is an employee non taxed reimbursement that meets the requirements allowable under Treasury Regulations:

  • S1.132-5(a)(1)(v)
  • S1.62-2(c) (1)

These types of reimbursements are not unlike Section 125 Pre-tax medical savings programs and mileage reimbursements except they must meet the requirements outlined specifically in above United States Treasury Regulations.

In recent years, the validity of any tool reimbursement program has been under scrutiny to ensure they meet all the requirements of these regulations.

Many of the programs on the market did not, and still do not qualify. If a program
is determined not to qualify as an Accountable Plan, all reimbursements made would then become taxable.
